SMS Privacy Policy

The City of Clovis, NM (CITY) is committed to protecting members of the Public’s (PUBLIC) SMS “Text messaging” privacy. This Privacy Policy (“Policy”) governs how the CITY treats the Personal Information that the CITY collects and receives from members of the PUBLIC in connection with their use of the CITY’s SMS Service (“Service”), which the CITY makes available to you through a third-party service provider.

By using the Service, members of the PUBLIC agree to the terms of this Policy. The CITY reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to members of the PUBLIC. The date of the last update will be posted at the top of this Policy for PUBLIC’s convenience. This Policy, and any changes, are effective as soon as posted. PUBLIC’s continued use of the Service following the posting of any changes to the Policy constitutes PUBLIC’s full acceptance of those changes.

“Members of the Public (PUBLIC)” means any person, entity, corporation or individual in the United States.

“Personal Information” is information that individually identifies PUBLIC, such as your mobile phone number or user/screen name, as well as the any Personal Information that PUBLIC choose to include in messages sent through the Service.

What Personal Information is collected about PUBLIC.

Through the use of the Service, the CITY will receive the following information from our third-party service provider: PUBLIC’s mobile phone number when they send a text message to us, the text of messages that PUBLIC send to other users of the Service, any user or screen name that PUBLIC’s select in connection with the Service, as well as any comments or feedback regarding the Service that PUBLIC send to the CITY.

How the CITY uses Personal Information about you.

The CITY uses Personal Information to (a) provide PUBLIC with the Service, (b) process and respond to inquiries, (c) improve the Service, (d) if necessary, contact PUBLIC with important announcements or messages, (e) conduct research, and (f) provide anonymous reporting for internal and external clients and partners.

Each message that PUBLIC send through the Service (either to the CITY or to other users of the Service) is not stored on the CITY’s servers. The CITY utilizes services owned and provided by a third-party, RingCentral.

Disclosure of your information.

The CITY will not rent or sell your Personal Information to other companies or individuals.

The CITY shall enforce the Terms of Service.

The CITY responds to Inspection of Public Records (IPRA) requests, Freedom of Information Act (FOIA) requests, subpoenas, court orders, or legal process, or to establish or exercise the CITY’s legal rights, or the legal rights of others, or defend against legal claims.

The CITY may to share Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the CITY’s Terms of Service, or as otherwise required by law.

Security.

The CITY takes precautions to ensure the security of PUBLIC’s Personal Information, including ensuring that our third-party service providers protect the security of PUBLIC’s Personal Information. However, the CITY cannot guarantee that hackers or unauthorized personnel will not gain access to PUBLIC’s Personal Information despite our efforts. PUBLIC should note that in using the Service, PUBLIC’s information will travel through third-party infrastructures which are not under our control (such as a third-party SMS delivery platform or PUBLIC’s carrier network).

The CITY cannot protect, nor does this Policy apply to, any information that PUBLIC transmits to other users. PUBLIC should never transmit personal or identifying information to other users.

Opting in.

A mobile user may opt-in by:

Entering a phone number online,

Sending a Mobile Originating (MO) message containing “START”,

Filling out a paper form that includes their phone number, or

Signing up at a point-of-sale location.

Opting out.

The CITY’s third-party service provider gives PUBLIC the ability to opt-out of the Service for any reason. PUBLIC can opt-out by texting “STOP” or “QUIT”.

The CITY reserves the right to send PUBLIC certain communications relating to the Service, such as announcements and administrative messages, without offering PUBLIC the opportunity to opt-out of receiving them.

Children.

The Service is not intended for children under 13, and the CITY does not knowingly collect information from children under the age of 13.

Children aged 13 or older should not submit any Personal Information without the permission of their parents or guardians. By using the Service, members of the PUBLIC are representing that they are at least 18, or that they are at least 13 years old and have their parents’ permission to use the service.

Intended audience.

The CITY requires that users of this service be limited to US residents only.

SMS Terms of Service

Use of the the CITY text message-based services (the “Service”) is subject to the following Terms of Service. These terms constitute a legal agreement (the “Agreement”). Please read them carefully.

The CITY will allow several different opportunities, such as entering a phone number online, to opt-in to SMS services.

Members of the PUBLIC can cancel the Service at any time. Just text “STOP”. After sending the SMS message “STOP” to the CITY, the CITY will send an SMS message to confirm the un-subscription. After this, no more SMS messages from the CITY. If a member of the PUBLIC want to join again, just sign up as they did the first time, and the CITY will start sending SMS messages to you again.

If at any time members of the PUBLIC forgets what keywords are supported, just text “HELP”. After sending the SMS message “HELP” to the CITY, the CITY will respond with instructions on how to use the Service as well as how to unsubscribe.

The CITY is able to deliver messages to most major mobile phone carriers. ***Carriers are not liable for delayed or undelivered messages***

As always, message and data rates may apply for any messages sent to members of the PUBLIC from the CITY and to the CITY from members of the PUBLIC, and the CITY is not liable for the cost of any such messages. Members of the PUBLIC will receive recurring messages. Questions about text or data plans, it is best to contact their wireless provider. Members of the PUBLIC understand that anyone with access to their mobile phone may be able to view the messages they receive when using the Service and agrees that the CITY will not be liable if this occurs.

Members of the PUBLIC understand that they are not required to consent to the Service to receive any other services from the CITY.

By agreeing to these Terms of Service and providing the CITY with their mobile phone number when they opt-in to the Service, they authorize the CITY to contact members of the PUBLIC by text message at their mobile phone number using an automatic telephone dialing system or device, or any other computer assisted technology as applicable.
